By accessing and using KK Sounds, you accept and agree to be bound by the terms and conditions of this agreement. In addition, when using KK Sounds particular services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into the Term and Conditions.

ANY PARTICIPATION IN KK SOUNDS WILL CONSTITUTE ACCEPTANCE OF THIS AGREEMENT.

  1. INTELLECTUAL PROPERTY: All recordings available for purchase through KK Sounds are the intellectual property of Kohl Kitzmiller (owner of KK Sounds). Each recording is to be distributed to only one performing ensemble and is hereby not permitted to be shared with any additional performing ensembles. Learning tracks must be purchased new for every ensemble intending to perform said piece of music.
  2. DISCREPANCIES: Any accuracy discrepancies between the sheet music possessed by the purchaser and the learning tracks downloaded from KK Sounds is not the responsibility of KK Sounds to fix. Any changes that the purchaser would like to make to the learning tracks may be completed for an hourly rate specified by KK Sounds. Upon the agreement of rate, revisions will be made within a timely manner.
  3. CONTESTABILITY: Learning tracks on KK Sounds have a note for “Contestability” which specifies whether a song is valid for contest. These notes for contestability are only recommendations and have not been filtered through a certified judge in either Sweet Adelines International or the Barbershop Harmony Society. To be entirely sure of a song’s legality for contest, I strongly recommend reading the judging handbooks for Sweet Adelines International and the Barbershop Harmony Society.
  4. MECHANICAL LICENSING: Mechanical licensing fees are the sole responsibility of the purchaser. By purchasing learning tracks from KK Sounds, you agree to the responsibility of paying mechanical licensing fees for any and all copies that you make for your performing ensemble. For more information about mechanical licensing fees, visit Harry Fox. Mechanical licensing fees are collected to pay royalties to the copyright owners. The current cost is $0.091 per copy and you must pay for a minimum of 25 copies. The arranger owns the copyright on any public domain song and will likely need to pay the copyright holder directly for public domain songs.
  5. ARRANGEMENT LEGALIZATION: KK Sounds is willing to assist in the redirection of a song’s legalization, but KK Sounds is not a publishing company and will not reach out to other publishers on behalf of your ensemble. The fees regarding legalization of an arrangement is the responsibility of the purchaser. Good resources for legalization are Tresona and the Barbershop Harmony Society (members only).
  6. REFUNDS: Refunds are not permitted for any reason unless there are extenuating circumstances to be determined by KK Sounds.
